1. Acceptance of Terms
These Terms of Service govern your use of the Soundguessr mobile application and website at www.soundguessr.com (collectively, the "Service") operated by Simon Noack ("us", "we", or "our").
By installing the app or using the website, you agree to these Terms. If you disagree with any part of the terms, you may not access the Service.
2. Service Description
Soundguessr is a game where users listen to environmental sounds and audio recordings from different locations around the world and guess where they were recorded. The app offers various game modes including daily challenges, custom challenges, and quick play.
The website provides information about the app and allows users to contact the company.
3. User Accounts
Full use of the app requires registration. You agree to provide truthful and complete information when registering and to update this information as needed.
You are responsible for maintaining the confidentiality of your login credentials. Any activity that occurs under your account is your responsibility.
We reserve the right to delete accounts that have been inactive for more than 24 months after prior notification.
4. License and Usage Rights
We grant you a non-exclusive, non-transferable, non-sublicensable right to use the app on compatible devices and to access the website.
Any use beyond the intended use, particularly copying, modifying, distributing, or making the app or parts of it publicly available, is prohibited without our prior written consent.
5. User-Generated Content
The app allows users to create their own challenges and upload audio recordings (hereinafter "user-generated content").
You guarantee that you own all rights to the user-generated content you upload and that it does not violate any third-party rights.
You grant us a non-exclusive, worldwide, royalty-free, transferable, and sublicensable right to use, reproduce, distribute, and make your user-generated content publicly available as part of the app and website.
We reserve the right to remove user-generated content that violates these Terms or applicable law without prior notice.
6. Prohibited Use
The following actions are prohibited:
- Uploading illegal, offensive, racist, violent, or pornographic content
- Manipulating the app or website, particularly through hacking, malware, or automated access
- Circumventing technical restrictions or security measures
- Advertising commercial products or services without our consent
- Any use that could impair the proper operation of the app or website
7. Availability and Modifications
We strive to ensure high availability of the app and website but cannot guarantee uninterrupted availability. In particular, availability may be temporarily limited due to maintenance work or technical disruptions.
We reserve the right to modify, update, or discontinue the app and website at any time. We will inform users about significant changes in an appropriate manner.
8. Premium Features
Basic use of the app is free. We may charge a fee for enhanced features or certain content. Before purchasing premium features, you will be informed about the price, payment terms, and your right of withdrawal.
Payments are processed through the app store of your respective operating system (iOS or Android) and are subject to their payment terms.
9. Liability
We are liable without limitation for damages resulting from intent or gross negligence, as well as for damages resulting from injury to life, body, or health.
For damages caused by slight negligence, we are only liable for breach of a material contractual obligation and only to the extent of the foreseeable, typically occurring damage. Material contractual obligations are those whose fulfillment enables the proper execution of the contract in the first place and on whose compliance the user regularly relies.
Liability under the Product Liability Act remains unaffected.
10. Privacy
The collection, processing, and use of personal data occurs in accordance with our Privacy Policy, which can be found at www.soundguessr.com/privacy.
11. Intellectual Property
All content included in the Service, such as text, graphics, logos, images, audio clips, digital downloads, and software, is the property of Simon Noack or its content suppliers and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
12. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including, without limitation, if you breach the Terms.
Upon termination, your right to use the Service will immediately cease.
13. Changes to Terms
We reserve the right to modify these terms at any time. The modified terms will be communicated to you via email or within the app. The changes are considered accepted if you do not object within four weeks of receiving the notification.
